  • UK Definition for Immigration: For immigration purposes, 'UK' excludes Crown dependencies, although time spent there may count towards the continuous period.
  • Exclusions: Periods spent working offshore beyond the UK's 12 nautical mile zone do not contribute to the continuous period.
  • Absences That Don’t Break Continuity: Certain types of absences, such as the time between receiving entry clearance and actually entering the UK, do not disrupt the continuity of the qualifying period. Also, absences shorter than 24 hours are not counted towards the 180-day allowable absence limit.
  • Tier 1 Dependents: Absences of dependents under Tier 1 categories prior to January 11, 2018, do not count towards the 180-day absence limit.
  • Specified Continuous Period: The qualifying period for ILR is calculated backwards from the date of the application, the date of the decision, or up to 28 days after the application.
  • Transitional Arrangements: For leaves granted on or after January 11, 2018, absences are considered on a rolling basis, while for earlier leaves, they are evaluated in consecutive 12-month periods.
  • Allowable Absences: Absences must be consistent with the original entry purpose or for a serious reason. In some categories, no reason is needed for absences if they do not exceed 180 days in a 12-month period.
